1. 2. Organizational context and scope of work  UNDP has been working in Libya since 1976. Since the outbreak of conflict in 2014 and the deteriorating humanitarian situation, UNDP Libya continues to support Libya’s transition to an inclusive political agreement, accountable governance, stabilization, economic recovery, and resilience. UNDP aims to support Libya’s transition to an inclusive political agreement through expansion of dialogue between different stakeholders, urgent rehabilitation of key public services, support to constitutional processes underway and national and local capacity-building to be able to address the urgent needs of citizens. UNDP partners with various government actors, non-governmental organizations, civil societies, the private sector, UN agencies and other organizations.  In recognition of recent political and security developments in Libya and related opportunities to enhance stability in Tripoli and avert the further erosion of institutional capacities, and against the backdrop of the UN Secretary-General’s decision to move ahead with relocating the United Nations into Libya, the Government of National Accord (GNA) has requested assistance from UNSMIL and UNDP to efforts of the Ministry of Interior, Libyan police and criminal justice institutions to advance security and the rule of law in Libya’s capital. Based on detailed assessments of the current context and capabilities, and in consultation with Libyan stakeholders, priority areas have been identified for programmatic engagement are as follows:Structure, roles and resourcing of local police and criminal justice institutions clarified and prioritized according to identified needs in TripoliReview and develop relevant SOPs (consistent with broader government reform efforts) such as on coordination between police and judicial police, communications flow, police operations and community policing, pre-trial detainee and prisoner tracking and case management, and prison management.Effectiveness of law enforcement and prison service delivery in Tripoli improved through provision of training and technical and material assistance.Establish vetting/selection and human resourcing plans and oversight procedures for police & prison personnel in Tripoli consistent with Libyan training and staffing needs as well as donor and UN human rights due diligence requirements.Ministry of Interior provided with capacity development and organisational assistanceSupport MOI implementation of civilian oversight and accountability mechanisms, systems, procedures, and codes of conductIn line with UN commitment to integrated assistance, and with support from the Global Focal Point arrangement for Police, Justice and Corrections, UNDP and UNSMIL are rolling out a ‘Policing & Security Joint Programme’ (PSJP), which will maximize the capabilities of the UN system in support of the GNA’s agenda in these critical areas. This joint programme is fully aligned with UNSMIL’s Security Council mandate and the UN Strategic Framework, and leverages UNDP’s capacities and expertise as a programmatic entity and development partner of the Libyan government.
3. Purpose and objective of recruitment   The international consultant will work closely with the national consultant and will be responsible for the following:Support MOI implementation of civilian oversight and accountability mechanisms, systems, procedures, and codes of conductReview and develop relevant SOPs (consistent with broader government reform efforts) such as coordination between police and judicial police, communications flow, and police operations.Establish vetting/selection and human resourcing plans and oversight procedures for police & prison personnel in Tripoli consistent with Libyan training and staffing needs considering donor and UN human rights due diligence requirements.Under the overall supervision of the Project Manager, the international consultant will work closely with national consultant they are expected to undertake the following activities:In close consultation with Technical Working Group, MoI, MoJ, Prosecutor General Office and relevant rule of law actors such as judges, lawyers, prosecutors, police, Judicial Police review and develop existing mechanisms, systems, Standard Operating Procedures for1) Civilian oversight and accountability, and2) Codes of conduct3) Referral/complaints handling systems police and prisons to facilitate fair and effective disciplinary hearings including violence against women4) Coordination between police and judicial police,5) Communications flow,6) Police operations and7) Mechanism to address arbitrary and illegal detention8) Fight against impunity, including the systematic prosecution of criminal offences committed by government salaried persons and9) Human Rights Due Diligence Policy Action PlanIn consultation with Technical Working Group and relevant government entities, prepare action plan for review, development, and finalisation of abovementioned policy documentsConduct workshops/consultation meetings to review and finalise the revised documents and implementation plan for roll out of1) Civilian oversight and accountability, and2) Codes of conduct3) Referral/complaints handling systems for police and prisons to facilitate fair and effective disciplinary hearings including violence against women4) Coordination between police and judicial police,5) Communications flow,6) Police operations and7) Mechanism to address arbitrary and illegal detention8) Fight against impunity, including the systematic prosecution of criminal offences committed by government salaried persons and9) Human Rights Due Diligence Policy Action Plan
4. Deliverables The consultant will work under the overall guidance of the project manager and in close collaboration with the project team in Tripoli.  S/he will be expected to produce the following deliverables:  
1) Prepare action plan in consultation with MoI, MoJ, Prosecutor General Office and the TWG for reviewing and developing: 5 Working days (50%)
1) Civilian oversight and accountability (2.1 INL),2) Codes of conduct (4.5)3) Referral/complaints handling systems police and prisons to facilitate fair and effective disciplinary hearings including violence against women (4.5)4) Coordination between police and judicial police, (SOP-4.5)5) Communications flow, (SOP-4.5)6) Police operations and (SOP-4.5)7) Mechanism to address arbitrary and illegal detention (2.3)8) Fight against impunity, including the systematic prosecution of criminal offences committed by government salaried persons and (2.1)9) Human Rights Due Diligence Policy Action Plan (2.1)2) Conduct consultative discussions meetings with technical working group, MoI, MoJ and relevant stakeholders for reviewing and developing policy documents mentioned above (Detailed progress reporting is required): 10 working days
3) Prepare and develop first draft of all the nine policy documents mentioned above (Detailed separate draft of each document is required): 9 working days
4) Conduct consultative workshops/ meetings/ discussions with technical working group, MoI, MoJ and relevant stakeholders for reviewing the first draft of all nine policy documents mentioned above (Detailed progress reporting is required): 9 working days
5) Finalise the draft after incorporating comments in the nine policy documents mentioned above and their implementation roll out plan (Detailed separate finalised document is required): 6 working days
6) Conduct validation workshops/ meetings/ discussions with technical working group, MoI, MoJ and relevant stakeholders for finalising all nine policy documents mentioned above and their implementation roll out plan (Detailed progress reporting is required): 3 working days
7) With the International consultant a final report for completion of all above mentioned nine policy documents, outcome, stating challenges and recommendation for future development: 3 working days
5. Selection Criteria  The offer will be evaluated by using the Best value for money approach (combined scoring method). Technical proposal will be evaluated on 70%. Whereas budget proposed will be evaluated on 30% based on sufficiency for applying the data gathering techniques and for obtaining reliable data for the evaluation in the timeframe indicated. Below is the breakdown of technical proposal on 100% which will be brought to 70%:
Advanced university degree (Master’s or equivalent) in Rule of law and law studies, Human rights, public administration and public policies, governance, social sciences, or related disciplines: 10%Minimum of 15 years of progressively responsible experience in the design, planning and implementation of the policy and technical advice, accountability and oversight, monitoring, code of conduct, training, capacity development: 10%Proven knowledge and background in Rule of Law, gender, human rights, and security sector: 10%Adequate skills to develop methodology and work plan (techniques for gathering and analyzing qualitative and quantitative data for accountability mechanisms, code of conduct and policy papers): 10%Demonstrated experience in designing and implementing gender-sensitive oversight, monitoring and accountability mechanism, and training programmes: 10%Proven experience in engaging with stakeholders including government counterparts in developing policy papers, monitoring and oversight mechanisms, and code of conduct: 10%Excellent Arabic and English writing and communication skills: 10%
6. Disbursement of payments. Payment will be made in two instalments upon completion of all deliverables and submission and approval of the final report and timesheet as indicated in the TORs.
1) 50% up on completion of deliverables 1, 2, 3 and 42) 50% up on completion of deliverables 5, 6 and 77. Timeframe and Estimated workday duration
The duration of the contract will be 45 working days over two months period

9. Required Skills and Experience 
Qualifications: Advanced university degree (Master’s or equivalent) in Rule of law and law studies, Human rights, public administration and public policies, governance, social sciences, or related disciplines

10. Language Requirements:Language proficiency in English and Arabic is required.
