Poste proposé : Contract Superintendent

The Contract Superintendent (CS) is responsible for implementing and coordinating, throughout the life cycle of contracts, the means, and processes necessary to control the company’s risks (operational, financial, and contractual) during the contract execution. Thus, the role of the Contract Superintendent contributes to improving the operational and financial performance of contracts, particularly by:

  • Controlling operational risks (gaps in safety and quality, technical non-compliance) and financial risks (additional costs, budget overruns, schedule slippage, deterioration of margins, etc.) in close collaboration with contract owner (operation’ representative).
  • Contributing to optimize expenses and financial gains.
  • Guaranteeing respect of the Group’s values and compliance with our regulatory and contractual commitments (in particular responsible purchasing, Ethics & Compliance and CSR policies).
  • Optimizing the legal litigation strategy (particularly during the pre-litigation phase).

Responsibilities;

The Contract Superintendent must guarantee good management: 

  • of the execution of contracts by ensuring compliance with contractual and regulatory obligations by the contracting parties and their possible representatives.
  • of modifications to the contract. o of the claims and counterclaims.
  • of the closing of contracts.

Contract Management

In the exercise of his responsibilities, the Contract Manager is required to ensure the execution of contracts in compliance with the Safety, CSR policy and the Endeavor Mining Group Ethics charter, internal procedures, and regulations in force in the country of the entity concerned.

 As such, and in coordination with stakeholders, it is notably required to:

  • Ensure that documentation and exchanges between the parties are kept up to date and have good traceability;
  • Have a good understanding of the need, the operation and/or the project as a whole;
  • Ensure the consistency of all documents relating to contracts;
  • Assist the buyer and operational staff in the management of project and/or contract risks and
  • the implementation of mitigation measures, from the signing of the contract until the end of the implementation phase;
  • Participate in the revision of the Specifications (scope of work) and the definition of performance indicators for the tender package.
  • Administer and guarantee the monitoring of the proper execution of the actions and contractual obligations of the parties under the scope of work, specifications, and associated procedures;
  • Manage performance monitoring through progress monitoring, quality monitoring control, and follow-up of the closing of actions/decisions;
  • Monitor and manage the non-conformities, deviations, blockages or risks of disputes and litigation (notification and execution of remediation action plans)
  • Anticipate and propose the implementation of avenues of opportunity (e.g. revision of the Specifications, application of the terms of the contract or proposal for modifications to the contract);
  • Administer the inspection report, control, test and acceptance reports (final, single and/provisional);
  • Manage contractual warranty claims, notifications and the proper execution of associated action plans, cost management and associated planning;
  • Manage the closing of the contract, if necessary, prepare the closing report

Claim Management

The Contract Manager must secure the interests of the entity concerned in the management and development of complaints or counterclaims with a view to developing opportunities to improve financial performance, limit financial losses, optimize chances of amicable resolution of disputes and reducing the risks of litigation. As such, he will be responsible for:

  • Conduct the acceptability analysis of the contractual, legal and commercial basis.
  • Manage internally the development of counter-complaint and complaint files, financial estimates, planning or technical analysis as well as the analysis of Supplier/Service Provider complaints in coordination with (internal) stakeholders.
  • Participate in the development of the claim management strategy (pre-litigation) as well as in the negotiation of amicable resolution, if necessary, and manage the files with a view to minimizing the risks of legal disputes

Profil recherché pour le poste : Contract Superintendent

Requirements;

  • Bac+5, in Business Law, Business School, Management and Commerce School, general engineer or equivalent, with multidisciplinary knowledge in law, Project management, Purchasing procedures, Finance.
  • 10 to 15 years of industrial experience required, including a minimum of 5 years in the mining sector, and experience in contract or project management preferred.
  • Good English level allowing negotiation and a good understanding of technical and contractual documentation in English.
  • Good operational understanding of the areas of activity of the entity concerned.
  • Good coordination, initiative and leadership skills.
  • Good capacity for anticipation, analysis, synthesis and rigor; o Strong capacity for conviction, resilience and tenacity.
