DUTIES AND RESPONSIBILITIES
Piracy, armed robbery, drug trafficking and other illegal acts committed at sea plague the Gulf of Guinea with dire economic consequences for its riparian countries. Due to the reduced oil-prices and the weakened oil marked, attacks are no longer only targeting oil theft as previously seen, but also involving kidnappings for ransom, similar to what was experienced in East Africa. The lack of effective prosecution related to piracy and armed robbery at sea continues to undermine efforts to combat such crime. It is important for the region to change this trend and ensure that there is no impunity to attacks at sea.

In this context, UNODC GMCP has been promoting legal reform and training maritime criminal justice practitioners on the Law of the Sea and transnational organized maritime crime matters in the region. The support has comprised of legal assessments conducted with regard to piracy and maritime offences, establishing legal frameworks, and support in developing solid legislation in line with the UN Convention on Law of the Sea (UNCLOS) and other international maritime instruments.

In West Africa, GMCP is working currently on improving the criminal justice action and responses in Gulf of Guinea countries under the US-funded projects on “Strengthening the maritime crime legal frameworks in the Gulf of Guinea” with 3 beneficiary countries including Ghana, Cote d’Ivoire and Benin. In Central Africa, the same efforts are being made under the EU-funded regional project called PASSMAR(Programme to Support the Maritime Safety and Security Strategy in Central Africa). The geographical scope of the PASSMAR project covers Central Africa countries administrated by ROSEN and ROSAF: Angola, Cameroon, Congo, Democratic Republic of Congo (DRC), Gabon and Sao Tomé-et-Principe.
In line with these projects, the purpose of the consultancy is on two-fold:

1) To support Ghana, Benin and Cote d’Ivoire’s prosecution authorities in improving their legal response to piracy, and other maritime crime. To do so, the incumbent will coordinate work of various national consultants working in on-going legal reform initiatives in these countries.

2) To support the Regional Maritime Security Centre (CRESMAC), Economic Community of West Central African States (ECCAS) and Interregional Coordination Centre (ICC) in mapping legal frameworks and issuing recommendations. This assignment focuses on taking forward legal assessments already conducted by UNODC and other partners, updating them and work forward through an integrated approach with the mentioned institutions. Moreover, the incumbent will provide legal advice in drafting a hand-over agreement of piracy suspects for ECCAS.
