APM Terminals Medport Tangier is a greenfield project under construction, it will be the third container terminal of the Tanger Med complex APM Terminals Tangier handled 1.7 million TEUs in 2015. APM Terminals Medport Tangier will be a facility with up to 2,000 meters of quay.

Key responsibilities
PURPOSE
•Responsible for advising terminal management on all issues relating to the legal affairs & structure within the local framework.
•End responsible for resolving all legal issues that arise either directly or through the use of external legal firms.
•The scope of the job encompasses all legal matters relating to civil law, criminal law, commercial law, labour law, etc.
•Handling damage claims and insurance policies in compliance with the appropriate regulations. This includes investigation and assessment of damage to cargo, containers, equipment and other related property. Ensures all claims raised by internal and external parties follow proper reporting procedure. Represent Operations department with adjuster/ insurance company
•In Addition will be responsible to implement APMT Legal compliance guidelines with a focus on foreign trade controls, completion compliance and data privacy.
PRINCIPAL ACCOUNTABILITIES
•The incumbent will provide measurable input into new legal processes and standards that have a direct impact on the terminals overall results.
•The position is expected to analyze complex legal issues and ensure optimal resolving of these issues for the business.
•The position has an impact which is multi dimensional as non compliance can severely affect the overall port operations.
Accountabilities
•Advises terminal management on all issues relating to local legislation in all areas and required regulatory requirements from various local bodies
•Attends as terminal representative all hearings with relation to legal, regulatory or statutory matters either in court or with required local bodies
•Maintains & reports on follow up with all issues related to legal & statutory matters being handled by the terminal
•Maintains & develops local contacts with specialist legal firms on all issues, and liaise with external lawyers for Legal Disputes.
•Liaison with State and Government authorities for any matters and clearances related to the company
•Liaison with local bodies & agencies for all approvals & clearances required for effective terminal operations
•Responsible for finalizing the legal procedures for the Statute, board minutes, General assembly, Commercial register, powers of attorney, agreements..etc.
•Approves agreements entered into with all third party providers
•Negotiations with lawyers and contractors for all contracts (user, service and engineering contracts) and management of the same. Monitors the tender process.
•The position is required to keep abreast of all changes in law & regulatory issues & is the conscience keeper of the organization on these issues.
•Assists in the negotiation and renewal of insurance policies with insurers/ brokers.
•Responsible for compiling all evidence and reports involving insurance and claims, and coordinating with all parties involved.
•Initiates claim process for damage caused by external parties.
•Check and control all reports concerning claims, to be filled correctly and submitted to the proper authority.
•Proactive investigation, evaluation, management and resolution of claims.
•Clear analysis and accurate interpretation of insurance policies.
•Coordinate expert surveys and investigation of circumstances.
•Liaising and working closely with the commercial, Finance, CSR and other Departments to maintain an integrated approach to compliance across the company
•Develop awareness session for legal compliance procedures as per APMM guidelines
•Managing Compliance due diligence process and practices as per APMM requirements.
We are looking for
Incumbent has a mastery of the legal discipline, combining knowledge and theory with successful professional practice.
•Accredited legal qualification with a license to practice local law actively so that terminal matters can be handled directly by the incumbent in court
•5 to 7 years’ experience legal matters preferably in the port sector or in transportation. Experience in the construction field is preferred.
•Complete familiarization with local civil, criminal, and commercial, real estate, torts, labour laws & practices.
•Complete familiarity with rules & regulations of local bodies
•Familiar in Public Administration matters
•Incumbent must have a very high level of analytical skills & must have complete IT skills as required in an office environment
•Knowledge of local language, English is a must
•Must have ability to anticipate problems, manage prevention, recognize key issues in problems and create contingency plans and alternative solutions.
•Must be able to evaluate solutions for both long and short-term benefit.
•Exhibits sound judgment.
•Measures results and takes corrective action when needed.
•Exhibit effective negotiation skills
