Johannesburg, GautengReference Number: 474 1504 MHU Job Description:To take complete responsibility for Commercial Project Management (CPM) function including the Commercial execution of contracts in a project environment, including risk management, administration of contractual claims, project cash flow management and all commercial aspects of contract, statutory and corporate governance compliance. This role reports directly into the CFO. Responsibilities:Providing support during bidding phase:Provide input for drawing up a contracting philosophy that needs to be adopted for a project and during the negotiation of the commercial terms and conditions with the clientDraw up a strategy and identify key issues for association with business partners (Joint ventures, consortium, sub-contracting)Analysis of commercial aspects of a customer inquiry and provide key commercial and financial inputs to a make a competitive offerEvaluate the commercial and financial risks of the proposed bid and recommend appropriate risk mitigation measures during the bidding phase itselfEnsure compliance with internal directives pertaining to risk management aspects of the bid.Provide input on appropriate tax structure for the bid in consultation with the CAR departmentCommercial Execution:Take complete responsibility for the commercial execution of contracts.Ensure fulfilment of all commercial conditions laid down in the main contract with the customer as well as in related contracted with consortium partners, associated companies and other business partnersCo-ordinate all issues of financial project management (bank guarantees, parent company guarantees, letters of credit)Co-ordinate all tax and insurance related queries and interface with clients on these matters in consultation with CARProvide necessary support to procurement by vetting the purchase orders and sub-contracts to ensure that terms and conditions thereof are synchronized with the main contractConduct all commercial correspondence with the client and coordinate the negotiation and conclusion of contract amendmentsManage the administration of claims with customers, insurance companies and other parties involved in the execution of a contractEnsure that customers are invoiced in a timely manner in accordance with the contractManage the receivables portfolio and interface with customers to ensure on time collection of debtsHandle all foreign exchange matters pertaining contracts including making necessary applications, remittances and interface with company’s bankersEnsure that appropriate customs duty and other tax benefits are availedMonitor constantly the risks during execution of contract and proactively initiate risk mitigation measuresClient Focus:Conduct customer negotiations and interfaces with customers during project execution in a manner that strengthens long term relationship in a spirit of partnership and mutual trustUnderstand customer expectations and formulate appropriate solutions for mutual benefit while protecting the interests of the organizationMaintain high standards of service levels required for effective and progressive completion of assignment that meets customer’s expectationsProvide the Directors of the company with guidance as to their duties, responsibilities and powersConsciously build synergies with other departments and disciplines towards achievement of company goalsDirect management and control of staff in the department (with regard to quantity and qualification in order to support strategic requirements) Requirements: Qualification and SkillBachelor’s degree in commercial, accounting or financial management or equivalentIn-depth knowledge of FIDIC, NEC and other suites of contractsAt least 8 years relevant experience in the international contracting business especially with regard to project commercial execution / contract administration and controllingAt least 2 years’ experience in leading teams and/or managing staffProven track record in managing engineering projects preferably in the same industrySound legal knowledgeTrack record of experience in Claims Management, Insurance and ComplianceExperience in corporate governance and understanding of Company’s ActStrong client communications; contract drafting; communication skills; networking skills and high ability to influence; resilience; ability to cope in and often changing environment; attention to detail; reliable and trustworthy Benefits and Contractual information:Permanent position
